If I post bail, when can I get it back?

Answer:

If you are NOT the defendant, bail will be released by the Judge when the case is disposed. If the case is transferred to Grand Jury, you must wait until an order is received from the Superior Court. Bail is returned via check and is not available for pickup for approximately 1 week after release. Please note that a 3% bail poundage fee may apply.

If you ARE the defendant, bail will be released:

  1. After your case is disposed;
  2. After you have successfully completed your community service where required;
  3. After any fines are paid (unless bail is applied to the fine).

If your case has been transferred to grand jury, the court must receive an order from the Superior Court to release bail. Bail is returned via check and is not available for pickup for approximately 1 week after release. Please note that a 3% bail poundage fee may apply.
